Processing of personal data by  Klarta EU sp zoo on the warsaw-hygse.pl website
PERSONAL DATA CONTROLLER (hereinafter referred to as the ” Controller “)	Klarta Poland EU, a limited liability company, with its registered office in Warsaw (02-013), at 37/58 Adama Mickiewicza Street, entered into the register of entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, under KRS number 0000972396, Tax Identification Number (NIP) 5252902727, National Business Registry Number (REGON) 521614888 (hereinafter referred to as “Klarta”), providing services via the website www.warsaw-hygse.pl within the scope indicated in the Website’s regulations, hereinafter collectively referred to as the ” Regulations “
PURPOSES AND LEGAL BASIS FOR PROCESSING PERSONAL DATA	The Administrator processes your data for the following purposes: Performance of the contract for the provision of electronic services (Account, Newsletter) on the website (Article 6, paragraph 1, letter b of the GDPR), taking actions at the Customer’s request related to the conclusion of the contract and the implementation of the concluded purchase and sale contract, including the processing of payments, delivery and information on the order status (in the form of an SMS message and/or e-mail) (Article 6, paragraph 1, letter b of the GDPR), making online purchases without registering a Customer account, including making online payments, sending information about the order status (in the form of an SMS and/or e-mail) (Article 6, paragraph 1, letter b of the GDPR); fulfilling the legal obligations incumbent on the Controller, in particular those related to accounting and taxes and for archiving purposes (Article 6, paragraph 1, letter c of the GDPR); sending marketing content via a communication channel to which the Customer has voluntarily consented, i.e. via e-mail to the provided e-mail address and/or via text message and/or by phone to the provided telephone number, in order to present commercial offers and send personalized information about the Controller’s products and services – on the basis of the Controller’s legitimate interest (Article 6, paragraph 1, letter a of the GDPR); adapting and developing the functionality of the websites, including their structures and content, to the Customer’s needs, creating aggregated statistics and maintaining the security and quality of the services provided by the websites – based on the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR); pursuing or securing claims, delivering the purchase to a third party (other than the buyer) and maintaining the security and quality of the services provided, which constitutes the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR); consideration and execution of a complaint or other Customer notification (e.g. in connection with planned purchases of goods or purchased goods) is based on the performance of the contract (Article 6 paragraph 1 letter c of the GDPR) or the legitimate interest of the Controller (in the case of providing data of a third party (Article 6 paragraph 1 letter f of the GDPR);

TYPE AND SOURCE OF PERSONAL DATA	The scope of personal data obtained as a result of using the warsaw-hygse.pl website or the Administrator’s services (including the creation of an Account), depending on the type of services selected by the User, may include:    a) data identifying a natural person, i.e. name and surname, date of birth, address, account number, b) address and contact details, i.e. e-mail address and telephone number;   The data is obtained directly from the data subject.
DATA RECIPIENTS	Your personal data is transferred directly to the Controller and payment entities that cooperate with warsaw-hygse.pl or other entities, depending on the type of services provided to you.  Your personal data may also be transferred to entities authorized to request such data, e.g. the police, courts, prosecutors’ offices, in accordance with applicable law.  Access to the data we process may also be granted to: entities providing analytical, programming, accounting, HR and payroll, legal, tax, auditing, etc. services to us, cloud storage providers, providers of mailing and telecommunications services, and providers of e-mail services and other tools enabling communication with us.
TRANSFER OF DATA TO A THIRD COUNTRY OR INTERNATIONAL ORGANIZATION	Your personal data will not be transferred outside the European Economic Area or to an international organisation.
PERSONAL DATA STORAGE PERIOD	Your data will be processed: if the basis for the processing of personal data is consent, then the Customer’s personal data are processed by Klarta until the consent is withdrawn, and after the withdrawal of consent for a period of time corresponding to the limitation period for claims that Klarta may raise and which may be raised against it, if the basis for data processing is the performance of a contract, the Client’s personal data are processed by Klarta for as long as it is necessary to perform the contract, and after that time for a period corresponding to the limitation period for claims, if the basis for data processing is a legally justified purpose, the Customer’s personal data is processed throughout the duration of the account’s activity and in archived form until the statute of limitations for any claims expires, in the event that the processing involves cookies and similar technology, depending on technical issues, until these files are deleted using browser/device settings (however, deleting files does not always mean deleting personal data obtained through these files, hence the possibility of objection).
USER RIGHTS IN CONNECTION WITH THE PROCESSING OF HIS DATA	You have the right to access your data and the right to request its rectification if it is incorrect, its deletion or restriction of its processing, as well as the right to transfer this data.     To the extent that the basis for the processing of your personal data is the legitimate interest of the Controller, you have the right to object to the processing of your personal data.   To the extent that the processing of your personal data is based on consent, you have the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.   Pursuant to Article 21(2) of the GDPR, you also have the right to object to our processing of your personal data for marketing purposes.   If you have consented to the sending of commercial information electronically (e.g. via e-mail, SMS, etc.), you have the right to withdraw your consent. You also have the right to data portability, i.e., to receive your personal data from the Controller in a structured, commonly used, machine-readable format. You can also send this data to another Controller. The right to data portability does not apply to data that constitutes a trade secret.   You can submit any instructions regarding your personal data, including those regarding their deletion, in writing to the registered office address: ul. AUTOMATED DECISION MAKING	Profiling and automated decision-making techniques are not used.
INFORMATION ON THE VOLUNTARY OR OBLIGATION TO PROVIDE PERSONAL DATA	Providing your personal data is voluntary, but necessary to provide the services you have selected and to fulfill the obligations of the Administrator.

 

Cookie policy:

The online store uses so-called cookies to facilitate customer navigation and ensure the proper operation of the website.

Cookies are short text files saved by the Service Provider’s IT system in the User’s IT system (i.e. on the hard drive of computers or Mobile Devices of persons visiting the Website) mainly for the purpose of identifying Users on the Website and collecting general information on how the Website is used.

1. Types of cookies

The warsaw-hygse.pl online store uses two types of cookies:

– session cookies – remain on the user’s device until they leave the website or close the web browser;

– persistent cookies – remain on the user’s device for a specified period of time or until manually deleted by the user. Using cookie technology, the Website only collects anonymous statistical data about users to improve the user experience and minimize the impact of advertising. The Service Provider does not collect any data identifying Users as individuals or customers.

1. Changing search engine settings.

The user can change the privacy settings in search engines themselves.

Changes to the Privacy Policy

1. The Privacy Policy is constantly reviewed and updated as necessary. 
2. The change to the Privacy Policy comes into effect on the date of its publication on the website – each user of the website will be informed about the change to the Privacy Policy by e-mail.
3. Changes to the Privacy Policy may result from, among others (but not limited to): changes in legal regulations, introduction of a new functionality on the website, introduction of a new product, new processing purpose, need to share personal data with a new entity – partner or supplier. 
4. If a change to the Privacy Policy affects the principles of processing the user’s personal data, which are processed based on the user’s consent, each change to the principles (privacy policy in this regard) requires the user to provide new consent. The user will be asked for consent in the form established for contacting the user.
5. If the Privacy Policy changes concern the principles of processing the user’s personal data, which are processed on the basis of the Controller’s legitimate interest, the user will have the right to object to the processing of his or her data on the basis of the changed principles (see section: USER’S RIGHTS IN CONNECTION WITH THE PROCESSING OF HIS or her DATA). 
6. If a change to the Privacy Policy results from a change in legal provisions, the change shall apply to the user from the moment the amended Privacy Policy is published on the website or from the entry into force of the legal provision. 
7. If a change to the Privacy Policy concerns the rules for the processing of the user’s personal data, which are processed for the purpose of performing a contract for the provision of services by electronic means under the Regulations, each change requires the user’s acceptance (in accordance with the rules for changing the provision of services under the Regulations). 
8. Organizational, technical, editorial, and stylistic changes, as well as changes to the Administrator’s data, including contact details, shall come into effect on the date of publication of the amended Privacy Policy on the website, of which the user will be informed in accordance with point 2 above.
